Terms and Conditions of Marten Service LTD

Welcome to Marten Service LTD („we”, „our”, „us”). These Terms and Conditions („Terms”) govern your use of our electrical services, including any products, installations, repairs, and maintenance we provide. By engaging with Marten Service LTD, you agree to comply with these Terms.

Please read the following carefully.

1. General Provisions
1.1. Company Information:
Marten Service LTD is a registered company in United Kingdom, operating under registration number 11876683 , with its principal place of business at 217 Old Clough Lane, Walkden, Worsley M287JB.
1.2. Scope of Services:
Marten Service LTD provides electrical installation, repair, inspection, testing, and maintenance services for residential properties („Services”).
1.3. Acceptance of Terms:
By using our Services, you confirm that you have read, understood, and agreed to these Terms. These Terms apply to all clients engaging Marten Service LTD.

2. Quotations and Estimates
2.1. Quotations:
We provide quotations for our Services upon request. Quotations are valid for 14 days from the date of issue unless otherwise specified. After this period, prices may be subject to change.
2.2. Site Visits:
In some cases, a site visit may be necessary to provide an accurate quotation. This visit may incur a fee, which will be clearly communicated beforehand.
2.3. Estimates:
Estimates are provided as approximate cost projections and are not binding. Final costs may vary depending on the scope of work and unforeseen circumstances during the provision of Services.

3. Pricing and Payment
3.1. Prices:
All prices provided are included of VAT (unless stated otherwise). We reserve the right to adjust prices due to changes in material costs, labor rates, or other unforeseen factors.
3.2. Payment Terms:
A 50% deposit is required before the commencement of work. The remaining balance is due upon project completion. Payments can be made via Bank Transfer, Debit Card, or Cash, with the full balance required within 5 days of receiving the invoice.
For projects valued over £3,000, payment terms will be arranged individually and divided into five equal installments.
3.3. Late Payments:
Late payments will incur an interest charge of 5% per month on the outstanding amount. Failure to settle outstanding balances may result in the suspension of services or legal action.
3.4. Ownership of Materials
All materials supplied by Marten Service Ltd. shall remain the Company’s property until full reimbursement, inclusive of a 25% markup and applicable taxes, has been received. If the materials have already been installed or used and cannot be removed, the Company shall be compensated for the full value, including the markup and applicable taxes.
3.5. Design Approval and Modifications
Initial design concepts will be provided to the Client within 14 days from the project start date.
The Client is entitled to 2 rounds of revisions. Additional revisions may incur extra fees.
Once a design is approved by the Client, any further changes may lead to delays and additional costs.

4. Cancellation and Refund Policy
4.1. Cancellation by Client:
If you wish to cancel your order, you must provide written notice at least [48] hours before the scheduled work. Failure to do so may result in a cancellation fee of 10% of entire order.
4.2. Refunds:
Refunds for deposits or prepayments will be issued at our discretion. If work has already commenced, you will be liable for payment of services rendered up to the cancellation date.

5. Warranties and Liability
5.1. Service Warranty:
We provide a 6-month warranty for all electrical work performed by our technicians. This warranty covers defects in workmanship, but excludes normal wear and tear, misuse, or damage caused by third parties.
5.2. Limitations of Liability:
Marten Service LTD shall not be liable for any indirect, consequential, or special damages arising from the use of our Services, including but not limited to loss of profits, loss of business, or loss of reputation.
5.3. Force Majeure:
We are not liable for delays or failures in the performance of our obligations due to events outside of our control, including but not limited to natural disasters, strikes, wars, or government actions.

6. Health and Safety
6.1. Compliance:
All electrical work is performed in compliance with relevant safety standards and regulations, including the United Kingdom Building Regulations and Electrical Safety Standards.
6.2. Customer Responsibility:
The client is responsible for ensuring that the worksite is safe and accessible for our technicians. If unsafe conditions are identified, we reserve the right to postpone work until the issue is resolved.

7. Customer Obligations
7.1. Access to Property:
You agree to provide us with access to your property during reasonable hours to perform the Services. If access is not provided as scheduled, any additional costs incurred due to delays will be passed on to the client.
7.2. Permits and Approvals:
The client is responsible for obtaining any necessary permits, licenses, or approvals from local authorities. Marten Service LTD will not be held liable for delays caused by the failure to obtain such documentation.

8. Changes to Services
8.1. Alterations to Work:
Any changes to the agreed scope of work must be communicated in writing and may result in additional charges. We will provide you with an updated quotation for approval before proceeding with any alterations.
8.2. Additional Work:
If additional work is required beyond the initial scope due to unforeseen circumstances, the client will be informed, and the necessary adjustments to cost and schedule will be agreed upon before the work continues.

9. Termination
9.1. Termination by Marten Service LTD:
We reserve the right to terminate the contract if the client fails to meet their obligations under these Terms, including but not limited to non-payment, unsafe working conditions, or uncooperative behavior.
9.2. Consequences of Termination:
In the event of termination, you will be liable to pay for any work completed up to the date of termination and any additional costs incurred in relation to the termination.

10. Privacy Policy
10.1. Personal Data:
We collect and use personal data in accordance with our Privacy Policy. By using our Services, you agree to the collection and use of your information as described therein.
10.2. Third-Party Data Sharing:
We may share your information with third-party service providers as necessary to perform our Services but will not sell or disclose your information for marketing purposes.

11. Dispute Resolution
11.1. Governing Law:
These Terms shall be governed by and construed in accordance with the laws of United Kingdom.
11.2. Disputes:
In the event of a dispute, both parties agree to first attempt to resolve the issue amicably through negotiation. If the matter cannot be resolved, the dispute will be referred to arbitration or mediation in accordance with United Kingdom law.

12. Amendments
Marten Service LTD reserves the right to amend these Terms at any time. Any changes will be posted on our website and will become effective immediately upon posting. Continued use of our Services after changes have been made constitutes your acceptance of the revised Terms.
